Terms of Service
Last updated: March 13, 2026Welcome to World Wake App ("WWA", "the Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of the WWA platform at wwa.app and any related services. By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
1. Marketplace Operator Disclaimer
WWA operates as a marketplace platform connecting riders with cable wakeparks ("Service Providers" or "Park Operators"). The Platform facilitates booking transactions but does not itself provide wakeboarding services, equipment, or facilities. WWA is not a wakepark operator, sports facility, travel agency, or insurance provider. Each booking creates a direct contractual relationship between you and the relevant Park Operator. WWA acts solely as an intermediary facilitating this connection.
2. Eligibility
You must be at least 16 years old to create an account on WWA. By registering, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian to use the Platform.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials (password, passkey, or any linked third-party accounts). You must not share your account with others or allow unauthorized access.
You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period. We will provide reasonable notice before suspension unless immediate action is required for security reasons.
4. Bookings
The Platform allows you to browse wakepark availability, select time slots, and complete bookings. A booking is confirmed only when payment is successfully processed and you receive a booking confirmation.
Cancellation and refund policies are set by individual Park Operators and displayed during the booking process. WWA does not guarantee refunds — refund eligibility is determined by each Park Operator's policy.
If you fail to arrive for a confirmed booking (no-show), the Park Operator's cancellation policy applies. WWA is not responsible for refunds in case of no-shows.
Some Park Operators require you to accept a liability waiver before participating in activities. You are responsible for reviewing and understanding any waivers presented during the booking process.
5. Payments
Payments are processed securely through Stripe Connect. When you make a booking, the payment is split between the Park Operator and a platform service fee.
WWA charges a platform service fee (currently 2.9% of the booking total) to cover payment processing, platform maintenance, and customer support. This fee is displayed before you confirm payment.
All prices are displayed in the currency set by the Park Operator. Currency conversion, if applicable, is handled by Stripe at prevailing exchange rates.
Park Operators receive payouts directly from Stripe to their connected bank accounts. WWA does not hold customer funds.
Payment disputes should first be raised with the Park Operator. If unresolved, you may contact us at contact@wwa.app. For chargebacks or payment issues, Stripe's dispute resolution process applies.
6. Limitation of Liability
To the maximum extent permitted by applicable law, WWA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities.
WWA assumes no liability for injuries, accidents, property damage, or any harm occurring at wakepark facilities. Wakeboarding and related water sports are inherently risky activities. By booking through the Platform, you acknowledge these risks.
WWA is not liable for the actions, omissions, quality, safety, legality, or availability of services provided by Park Operators or any third-party service providers.
WWA is not liable for service interruptions, system outages, data loss, or errors in third-party payment processing (Stripe). We make reasonable efforts to maintain platform availability but do not guarantee uninterrupted service.
WWA does not guarantee any minimum uptime, availability, or service level. Park Operators and users acknowledge that they have no claim for compensation, lost revenue, lost bookings, or any other damages arising from platform downtime, scheduled or unscheduled maintenance, technical failures, or service interruptions, regardless of their duration or cause.
In any event, WWA's total aggregate liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to WWA (platform fees only, excluding payments to Park Operators) in the 12 months preceding the claim.
7. Warranty Disclaimer
The Platform is provided on an AS-IS and AS-AVAILABLE basis, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. WWA does not warrant that the Platform will meet your requirements, operate without interruptions, be error-free, or that defects will be corrected. Your use of the Platform is at your sole risk. No advice or information, whether oral or written, obtained from WWA shall create any warranty not expressly stated in these Terms.
8. Force Majeure
WWA shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay arises from events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, epidemics, government actions or restrictions, power failures, internet or telecommunications outages, distributed denial-of-service (DDoS) attacks, cyber attacks, or failures of third-party service providers (including Stripe, Supabase, and Vercel). During such events, WWA's obligations are suspended for the duration of the force majeure event.
9. Prohibited Conduct
You agree not to:
- Use the Platform for any fraudulent, deceptive, or unlawful purpose.
- Interfere with or disrupt the Platform's infrastructure, security, or other users' experience.
- Scrape, crawl, or use automated means to extract data from the Platform without written permission.
- Impersonate another person or misrepresent your affiliation with any entity.
- Send unsolicited communications or spam through the Platform.
- Attempt to bypass payment processing or circumvent platform fees.
- Upload or transmit viruses, malware, or other harmful code.
10. Intellectual Property
The Platform, including its design, code, graphics, logos, and content, is owned by WWA and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our written consent.
You retain ownership of any content you submit to the Platform (such as profile information and booking details). By submitting content, you grant WWA a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating the Platform.
11. Indemnification
You agree to indemnify and hold harmless WWA, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Poland.
13. Dispute Resolution
We encourage you to contact us first at contact@wwa.app to resolve any disputes informally. If we cannot reach a resolution within 30 days, either party may pursue formal legal proceedings under Polish law. EU consumers may also submit complaints through the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
14. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Platform or sending an email at least 14 days before the changes take effect. Your continued use of the Platform after the changes take effect constitutes acceptance of the revised Terms. If you disagree with the changes, you may delete your account.
15. Account Termination
You may delete your account at any time through your account settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy, subject to legal retention obligations.
We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. We will provide notice and an opportunity to export your data where feasible.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WWA regarding your use of the Platform. They supersede any prior agreements or understandings.
